Agreement to

Policies and Terms

By booking a session through any method, including online, email, phone, or in person, the client acknowledges that they have read, understood, and automatically agree to all policies and terms outlined below. No separate signature is required for acceptance.

BOOKING & PAYMENT

A non-refundable retainer of $20 is required to reserve your date and time. Your session is not considered confirmed until both the retainer and the completed booking form have been received. The remaining balance is due on the day of the session unless you have been instructed otherwise.

CANCELLATIONS & RESCHEDULING

If you cancel your session more than 24 hours before the scheduled time, you may transfer your retainer to a new date as long as the photographer is available. If you cancel less than 24 hours before the session, the retainer is forfeited. In cases of illness or emergency, the photographer reserves the right to reschedule the session with reasonable notice.

LATE ARRIVALS

All sessions begin and end at the scheduled times. If you arrive late, your shooting time may be reduced, late fees will apply, and no refunds or extensions will be provided. Please communicate if any cancelations are to occur, those who do not communicate and do not show will be prohibited from booking.

IMAGE DELIVERY & EDITING

The standard delivery time for edited images is approximately one to three days after your session. The photographer retains full artistic discretion over image selection and editing style. RAW or unedited images are not provided unless the request has been made in advance.

USAGE RIGHTS & COPYRIGHT

The photographer retains full copyright ownership of all images. Clients are granted personal-use rights that allow them to print, post, and share their images.

MODEL RELEASE

By booking a session, you grant the photographer permission to use your images for portfolio display, marketing materials, website galleries, and social media platforms. If you do not wish for your images to be used for promotional purposes, you must notify the photographer in writing before the date of your session.

LIABILITY

The photographer is not responsible for any injury, loss, or damage that may occur during the session. In the unlikely event of photographer illness, equipment failure, or other circumstances beyond the photographer’s control, the photographer’s liability is limited to either rescheduling the session or refunding any payments that have been received.

WEATHER POLICY FOR OUTDOOR SESSIONS

If weather conditions are unsuitable for your scheduled outdoor session, the photographer will contact you to reschedule. The decision to reschedule due to weather conditions is made solely at the photographer’s discretion.

TRAVEL POLICY

The photographer is based in Fayetteville, North Carolina. Any session that takes place more than fifty miles outside of Fayetteville will require an additional travel fee. The amount of this fee is determined by distance, travel time, and current fuel rates. All travel fees must be paid before the session date. Sessions outside the fifty-mile radius will not be confirmed until the appropriate travel fee has been paid.

BOOKING REQUIREMENTS

Clients must submit their booking request through the official website, either through the Contact section or the Booking section. A session cannot be confirmed unless the client provides their full name, phone number, and any other required information through the website form. If this information is not submitted through the website, the session will not be considered secured, even if communication or payment was attempted through other methods. A session is not officially reserved until both the booking form and the retainer payment have been received.

SAFETY & LOCATION APPROVAL

The photographer reserves the right to refuse or deny any location that appears unsafe, presents potential harm, or creates an environment that could risk the safety of the photographer, the client, or equipment. If a location is deemed unsafe, the photographer may request an alternative location or recommend rescheduling. A session will not proceed at any location the photographer considers unsafe.

AGREEMENT

By paying the booking retainer and securing your session, you confirm that you have read, understood, and agree to all policies and terms listed above. You also acknowledge that your booking serves as a binding agreement between you and Ellen Innovations.
